Despite the fact that during our lifetimes, most of us will need to take medical leave for a serious medical condition, many employers refuse to grant such leave, interfere with taking it, retaliate against employees seeking to take it, or replace employees while they are on it.  That is against the law.

The Family and Medical Leave Act (FMLA) protects an employee’s right to medical leave.  Most government employers, including universities, public agencies, and VA hospitals are covered by the FMLA.  Private sector employees are also covered if the employee has (1) been employed for a year, (2) worked at least 1,250 hours within the previous year, and (3) works at a worksite where there are 50 or more employees within a 75-mile radius.
